Sears Holding Corp.

Sears Holding Corporation was once one of the largest retailers in the United States with over 20,000 vendors. It filed for Chapter 11 bankruptcy on October 15, 2018. From the outset of the bankruptcy filing, Sarachek Law Firm (SLF) has been extremely active in this case on behalf of many clients. SLF pushed for clients to get paid by seeking immediate payment of administrative claims. It filed a legal memorandum to persuade the Bankruptcy Court to rule in our clients’ favor regarding the contentious issue of when goods are received by a Debtor for purposes of substantiating a 503(b)(9) administrative claims. While Sarachek Law Firm fought to keep Sears in business for the benefit of vendors and employees, it also moved to convert the case after the sale closed to stop needless attorney’s fees. In addition, SLF successfully defended Preference Demands from the Debtor. If you have received a Preference Defense Letter Sarachek Law firm can assist in negotiating a settlement.
